Terms & Conditions

A. Terms applicable to a Seller Only

1 In order for any items to be displayed on the Site you must first fill in and complete the sell document ("Sell Document").  All areas must be carefully completed, in particular the description of the goods (“Goods”) which you would like us to display.

2 We will review each Sell Document received and, in our absolute discretion, we will indicate to you by email (“Initial Email”) at the address contained in the Sell Document whether we are prepared (“Display Proposal”), subject to examination of the Goods, to display the Goods on the Site and at what price (“Price”).

3 You will have 7 days to indicate by email to us whether or not you are prepared to accept the Price (“Acceptance Email”) and to send us the Goods to the address indicated on the Site or otherwise as set out in the Initial Email.

4 Any failure to accept the Price and to send the Goods to us within such period will result in the cancellation of the Display Proposal.

5 Within14 days of the receipt by us of both the Goods and the Acceptance Email in accordance with these Terms and Conditions, we will confirm by email at the address contained in the Sell Document, in our absolute discretion, whether or not we are prepared, having examined the Goods, to proceed on the basis of the Display Proposal and the Price.

6 If we confirm that we are prepared to proceed, then we will display the Goods on the Site.

7 We shall be entitled to display the Goods with such photo and description as we shall in our absolute discretion determine.  Such description shall, however, be based upon and shall not materially differ from the description of the Goods in the Display Proposal Form.

8 If we are not prepared to proceed, we will inform you of this by email at the address contained in the Sell Document and you shall be entitled to collect the Goods at the address indicated on the Site or such other address as we notify you within a period of 14 days following such email.  Any Goods not so collected will be deemed as Unsold Goods and shall be dealt with in accordance with Part D of these Terms and Conditions.

9 Any Goods displayed on the Site will be displayed for a minimum period of 6 weeks (the “Display Period”).  We shall, however, be entitled to remove any Goods from display on the Site at any time in our absolute discretion.

10 One week prior to the expiry of the Display Period we will inform you by email at the address contained in the Sell Document of any unsold Goods. You will have the option exercisable within 7 days of such email to reduce the price by 50% and place the goods on the Site under the banner entitled “Last Chance” for a further period of 2 weeks (“Reduced Period”).

11 Any Goods which remain unsold after the Reduced Period or which you do not exercise the option to have them placed under the "Last Chance" banner of the Site will be dealt with in accordance with Part D of these Terms and Conditions.

12 Any Goods for which there is a buyer (“Buyer”) and for which a sale transaction is concluded will be despatched to the Buyer in accordance with Part B of these Terms and Conditions

13 Depending on the commission option you select before goods are uploaded to the site, 25% or 50% of the proceeds of sale of any Goods (“Sales Proceeds”) will be deducted and retained by us by way of payment by you of our sales commission.  The balance of the Sales Proceeds will be paid to you by cheque within 7 days of receipt by the Buyer of the Goods.  In the event that the Price exceeds Euro 1000, we will agree the sales commission with you at the same time as agreeing the Price.

B. Terms Applicable to a Buyer Only

1 We take no responsibility whatsoever for the genuineness, condition, quality, fitness or merchantability quality of any Goods displayed on the Site or that they match the descriptions applied to them on the Site.  We also take no responsibility whatsoever for whether any Goods belong to the relevant Seller, whether the Seller has any right, title or interest in the Goods or not or whether any such Goods are the subject of any third party rights or liens of any kind.  This is a matter solely for you and the Seller.

2 By making a purchase of Goods on the Site you are entering into a contract with the Seller for the sale and purchase of those Goods.  You are not entering into a contract with us.

3 We are acting as the agent of the Seller and in no other capacity whatsoever.  We have no intention to create legal relations with you or anyone else other than as agent on behalf of the Seller in accordance with these Terms and Conditions.

4 We will deliver to you in accordance with the instructions contained in the purchase document the Goods in respect of which you have made a purchase within 7 days of receipt by us of payment for the Goods.

5 You will have 48 hours after receipt of the Goods to inform us by email that you are unhappy with the Goods and a further 5 days to return such Goods to us at the address indicated on the Site or as otherwise indicated to you. You must return the Goods in the same condition as that in which you received them. You must pay for the cost of returning the Goods and any Paypal transaction charges Returns must be sent back to us by registed post the cost of which is your responsibility.

C. Terms Applicable to Buyer and Seller

1 The privacy of your personal data is important to us and we shall ensure that we comply with all relevant data protection legislation. However, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of information transmitted to the Site and any transmission is at your own risk. Once we receive your information, it will be stored on our secure servers and we will use strict procedures and security features to try to prevent unauthorised access.

2 We may send newsletters and other marketing communications to you from time to time. Please let us know if you would prefer not to receive these.

3 We shall all times keep your personal data confidential and we shall not, without your prior consent, disclose your personal data to any third party unless required to do so by law.

4 We shall not be liable to you for any loss or damage arising as a result of our being prevented from performing our obligations under these Terms and Conditions by reason of circumstances beyond our reasonable control.

D. Unsold Goods – Applicable to a Seller Only

1 You will have the right to the return of any Goods which remain unsold after the Reduced Period or which you do not exercise the option to have them placed under the "Last Chance" banner of the Site or having been placed under that banner remain unsold for a further period of 2 weeks ("Unsold Goods") or goods which we have received but which in respect of which we have indicated to you that we are not prepared to proceed with and put on the site.

2 In order to exercise that right you must collect the Unsold Goods in person from the address indicated on the Site or otherwise indicated to you within 14 days of our email notifying you of Unsold Goods.  Alternatively, we may, in our absolute discretion, arrange at your cost for the Unsold Goods to be delivered to you.

3 Any Unsold Goods not collected by you in that period and for which there is no agreement between us for us to deliver the Unsold Goods to you, will be disposed of by us on your behalf in such manner as we shall determine including by our giving them, free of charge, to a charity of our choice.

4 You will have no further right, title and interest in any Unsold Goods disposed of by us in that way.

E. Authorisations of the Seller

1 You appoint us as your agent to find buyers for Goods which we have agreed to display on the Site from the visitors to the Site.  Our sole responsibility to you shall be to display the Goods on the Site in accordance with these Terms and Conditions.

2 As your agent, we shall have full authority to do all acts, enter into all contracts and to dispose of and otherwise transfer title to the Goods on your behalf in connection with the sale and purchase of the Goods and as contemplated by these Terms and Conditions.

3 You hereby represent and warrant that any Goods displayed by us on your behalf on the Site are genuine and not counterfeit and match the description of them in the Sale Document and are legally and beneficially owned by you free of all third party rights.

4 You hereby indemnify us and agree to keep us indemnified against all losses, costs and expenses suffered or incurred by us in acting as your agent in connection with the Goods and for any breach of such representations and warranties.

F. Pricing and Delivery

1 All pricing on the site are in Euro and are inclusive of applicable VAT. Prices do not include deliver charges. Delivery charges will be charged to either the Seller or the Buyer as indicated on the Site.

2. Where Goods are being delivered to you by us it is your responsibility to ensure that you are available at the address given when the courier company delivers the goods. If you are not, it will be your responsibility and at your cost to make arrangements with the courier company for an alternative delivery time.
